The Senate Judiciary Committee is discussing the nomination of Elena Kagan to the US Supreme Court. No mystery really about how folks will vote. But it's an opportunity for Senators to rehash their arguments for and against. GOP Senator Jeff Sessions of Alabama said he didn't think he dissed Thurgood Marshall when he labeled him an activist judge. He said he wants a justice who's a lawyer's lawyer, not a "political lawyer."
Put him down as a "no" vote.
Democratic Chairman Patrick Leahy of Vermont put it this way: "I suspect that no minds on the Committee will be changed by what we say today."
