Jackson family lawsuit against concert promoter still on

The show did not go on – but a lawsuit over Michael Jackson’s concert tour will.

The pop singer’s mother Katherine Jackson claims concert promoter AEG Live is responsible for an exhausting rehearsal schedule that weakened her son – and for medical care provided by Dr. Conrad Murray that killed him. She and Jackson’s three children are suing the entertainment giant.

Attorneys for AEG Live filed a motion to dismiss the case; they say the company had no control over the way Jackson lived his life – and could not have foreseen that the singer was willing to have Murray use the sedative propofol to treat insomnia.

For now, LA Superior Court Judge Yvette Palazuelos says the suit can move forward, but she wants to see evidence to back up its allegations. For example: the suit claims Jackson’s suffering caused his oldest son “great trauma and severe emotional distress.”

Judge Palazuelos wants to see some proof of that. Everyone will be back in court in six weeks.
