Staff Sgt. Robert Bales (L) is now in U.S. custody.

Military investigators continue to gather information as they build the case for criminal charges against Staff Sergeant Robert Bales.

While not formally charged, the soldier is accused of the massacre of 16 people in Afghanistan, more than half of them children and most from a single family.

Eugene Fidell, professor at Yale Law School, joins the show to discuss the legal proceedings against Bales and whether or not he will face the death penalty.

Eugene Fidell teaches military justice at Yale Law School.
