The case from the plaintiffs: arguing against Prop. 8’s constitutionality

After several defeats at the polls and a few more in the courts, it might have been the best week that the same-sex marriage movement has had in California in quite some time. The plaintiffs in the federal lawsuit, challenging the constitutionality of the gay-marriage-banning Proposition 8, aggressively attacked the witnesses and logic of the Prop. 8 defense, namely that same-sex marriage undermines traditional marriages between men and women. The cross examination was highlighted by a tense exchange between plaintiff’s lawyer David Boies and the main witness for the defense about how, exactly, same-sex marriage threatened traditional marriage. We heard from the defense yesterday and today Patt talks with the plaintiffs as the Prop. 8 trial draws to a close.
